Crystals From Brazil is a trading name operated by Moderna do Brazil Comércio e Serviços Ltda., CNPJ 32.900.836/0001-39.
Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to Crystals From Brazil.
By visiting our website, purchasing a product, creating an account, or otherwise using our services, you agree to these Terms of Service and to our Privacy Policy, Refund Policy and Shipping Policy.
If you do not agree with these Terms, please do not use our website or purchase our products.
1. OUR PRODUCTS
Crystals From Brazil specializes in natural crystals, minerals, gemstones, mineral specimens, decorative stones and related products.
Natural minerals are unique products formed by nature.
Variations in color, shape, transparency, inclusions, veins, internal fractures, cavities, crystallization patterns, surface irregularities, dimensions, weight and other geological characteristics are natural and are not considered defects when they are consistent with the photographs and product description.
We make reasonable efforts to display products as accurately as possible. However, colors and appearance may vary depending on lighting, photography, screens and device settings.
Whenever a listing identifies an item as a unique or one-of-a-kind piece, the customer will receive that specific piece unless otherwise stated.
2. PRODUCT INFORMATION AND MEASUREMENTS
We make reasonable efforts to provide accurate descriptions, dimensions, weights and photographs.
Because natural stones and minerals may have irregular shapes, measurements and weights may have small variations.
Product descriptions, photographs and specifications may be corrected or updated if an error is discovered.
3. ORDERS
Placing an order constitutes an offer to purchase.
We reserve the right, where permitted by law, to accept, decline, cancel or request additional verification for an order.
An order may be cancelled or held if:
• Payment cannot be verified.
• Fraud or unauthorized activity is suspected.
• Product information or pricing contains a material error.
• Shipping to the destination is unavailable or restricted.
• Export or import requirements cannot reasonably be fulfilled.
• Additional information is required from the customer.
For high-value orders, we may request identity, payment or delivery verification before shipment.
4. PRICES AND PAYMENT
Prices displayed on our website are those applicable at the time the order is placed.
Payment must be successfully authorized before an order is processed.
We may use third-party payment providers, including Stripe, PayPal and other providers available through Shopify.
Payment processing may be subject to the separate terms and conditions of those providers.
5. FREE SHIPPING
When an order is advertised as FREE SHIPPING, Crystals From Brazil pays the shipping cost on behalf of the customer.
Free shipping does not mean that transportation has no cost.
Where permitted by applicable law and as described in our Refund Policy, the actual outbound shipping cost paid by Crystals From Brazil may be deducted from a refund when a voluntary return is exceptionally accepted.
Mandatory consumer rights remain unaffected.
6. SHIPPING AND DELIVERY
International delivery times are estimates and are not guaranteed unless expressly stated otherwise.
Our standard international delivery estimate is generally 8 to 15 business days, subject to product preparation, destination, customs procedures and carrier operations.
Some products may require additional preparation time because of their size, weight, fragility or value.
Large, heavy, fragile or high-value pieces may require:
• Reinforced packaging.
• Special protective materials.
• Custom wooden crates.
• Additional export preparation.
• Specialized carrier arrangements.
When special packaging or custom crating is required, additional preparation time may apply before the shipment is handed to the carrier.
Delivery delays caused by customs authorities, carriers, weather, security inspections, incorrect addresses, import documentation or events outside our reasonable control do not constitute a breach of these Terms, subject to applicable consumer law.
7. CUSTOMS, IMPORT DUTIES AND TAXES
Customers are responsible for understanding the import requirements applicable in their destination country.
Unless expressly collected at checkout, customs duties, import taxes, brokerage charges, local taxes and government fees are the responsibility of the customer.
Crystals From Brazil is not responsible for delays caused by customs authorities.
Customers must provide any information reasonably required for customs clearance.
If a shipment is refused, abandoned, unclaimed or returned because the customer fails to pay required import charges, fails to provide required documentation, provides an incorrect address or fails to accept delivery, our Refund Policy will apply.
8. RISK OF DAMAGE AND DELIVERY INSPECTION
Natural crystals and minerals may be heavy, fragile and valuable.
Customers should inspect their package promptly after delivery.
If a product arrives damaged, customers should retain all packaging and contact us as soon as possible.
We may request:
• Photographs of the product.
• Photographs of the external package.
• Photographs of internal protective packaging.
• Video showing the condition of the item.
• Carrier documentation.
Claims involving shipping damage will be handled according to our Refund Policy and applicable law.
9. RETURNS, REFUNDS AND EXCHANGES
Purchases are subject to our Refund & Return Policy.
As a general commercial policy, sales are final and we do not normally accept returns or exchanges for change of mind.
Where permitted by applicable law, a voluntary return exceptionally authorized by Crystals From Brazil may be subject to a 15% restocking fee and other conditions stated in our Refund Policy.
Mandatory consumer rights, including statutory cancellation or withdrawal rights that may apply in the European Union, United Kingdom or other jurisdictions, are not limited by these Terms.

10. CUSTOM AND SPECIAL-ORDER PRODUCTS
Custom-made, modified, engraved, cut-to-size, drilled, mounted, based, polished-to-order or otherwise specially prepared products may be considered final sale where permitted by applicable law.
Once custom preparation has started, cancellation may no longer be possible except where mandatory law provides otherwise.
11. NATURAL CHARACTERISTICS ARE NOT DEFECTS
Customers acknowledge that natural crystals and minerals may contain characteristics including:
• Natural fissures.
• Internal fractures.
• Mineral inclusions.
• Veins.
• Cavities.
• Irregular edges.
• Variations in transparency.
• Variations in color.
• Differences in crystal formation.
• Natural surface irregularities.
These characteristics are part of the geological nature of the product and are not considered manufacturing defects when reasonably represented in the product listing.
12. NO MEDICAL OR PROFESSIONAL CLAIMS
Any cultural, historical, spiritual, metaphysical or traditional information concerning crystals or minerals is provided for general informational purposes only.
Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition.
Information provided on our website should not replace medical, psychological, financial, legal or other professional advice.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of this website, including photographs, product images, descriptions, text, logos, graphics and branding, belongs to Crystals From Brazil, Moderna do Brazil Comércio e Serviços Ltda., our licensors or other respective rights holders.
Content may not be copied, reproduced, distributed, commercially exploited or republished without prior authorization, except where permitted by law.
14. PROHIBITED USES
You may not use our website or services:
• For unlawful or fraudulent activities.
• To interfere with website security.
• To distribute malicious software.
• To impersonate another person or organization.
• To submit false payment or identification information.
• To infringe intellectual property rights.
• To collect customer or website information unlawfully.
• To interfere with the proper operation of the store.

Purchases made through this store are transactions between the customer and Crystals From Brazil.
Shopify and other third-party providers are not the seller of our crystals and minerals.

17. ERRORS AND OMISSIONS
Occasionally our website may contain typographical errors, inaccurate information or omissions relating to descriptions, prices, availability, shipping or other information.
Where permitted by law, we reserve the right to correct such errors and update information.
If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate solution in accordance with applicable law.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Crystals From Brazil and Moderna do Brazil Comércio e Serviços Ltda. will not be liable for indirect, incidental, special or consequential losses arising from the use of our website or products.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Nothing in these Terms limits mandatory consumer rights.
19. FORCE MAJEURE
We will not be responsible for delays or failure to perform obligations caused by events outside our reasonable control, including natural disasters, strikes, carrier interruptions, customs delays, government restrictions, war, civil disturbances, epidemics, severe weather, transportation disruption or failures of communication or payment systems.
This provision does not remove any mandatory rights available to consumers under applicable law.
20. GOVERNING LAW
These Terms are governed by the laws of Brazil.
Subject to mandatory consumer protection laws that may apply to customers in their country of residence, disputes relating to Crystals From Brazil shall be handled under applicable Brazilian law and, where legally permitted, by the competent courts of São Paulo, State of São Paulo, Brazil.
Nothing in this provision removes any mandatory jurisdiction or consumer protection right that applicable law grants to the customer.
21. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
22. CHANGES TO THESE TERMS
We may update these Terms periodically.
The most current version will be published on our website.
Material changes will apply in accordance with applicable law and will not retroactively remove rights already acquired by customers.
